Terms and Conditions

Definitions

In these Terms and Conditions, the following definitions apply:

Offer: the (product and/or service) offer of a Third Party that can be accepted by another natural or legal person via the Platform.
Terms and Conditions: these Terms and Conditions of RevitalSource.
Services/Products: the (commercial) services and/or products offered through the Platform to Users on behalf of Third Parties by RevitalSource in its capacity as an affiliate.
User(s): any natural and/or legal person using the Platform, including Third Parties.
Third Party/Parties: the natural person or organisation/legal entity (or its representative) for whom RevitalSource provides affiliate services.
Party/Parties: RevitalSource and/or the User(s).
Platform: the website(s), social media account(s), app(s) and other tools of RevitalSource and its affiliated companies and business partners through which the Services/Products and Products are made available.
RevitalSource: RevitalSource, located at De Dynamo 41, 3821 CJ Amersfoort, The Netherlands, which offers the Services/Products of Third Parties to Users via the Platform and receives a commission for this.

Applicability

These Terms and Conditions apply exclusively to all legal relationships with RevitalSource. Any general terms and conditions or other provisions used by the User that deviate from these Terms and Conditions are expressly rejected by RevitalSource.

By using the Platform, the User accepts these Terms and Conditions.

Offer

RevitalSource publishes the Offer on behalf of Third Parties on the Platform, based on information provided by Third Parties or based on RevitalSource’s own experiences and information.

RevitalSource accepts no responsibility or liability for the content of the Offer or for the information presented on the Platform.

Information from or originating from the Platform may not be reproduced or shared with third parties without prior written consent from RevitalSource.

Misuse of the Platform

Use of the Platform is not permitted for actions or behaviours that violate laws, regulations, public order or morality. In particular, it is prohibited to distribute indecent, immoral or discriminatory expressions via the Platform.

Additionally, the User is not permitted to:

  • de‑assemble, decompile or reverse engineer the Platform;

  • use the Platform for commercial purposes;

  • connect the Platform to a network allowing other devices to use the Platform;

  • make the Platform available to third parties in any manner;

  • use the Platform to excessively send data/messages, or distribute viruses or harmful software;

  • use the Platform in any way that may harm or adversely affect RevitalSource.

Maintenance and Adjustments

RevitalSource will make every reasonable effort to ensure proper functioning of the Platform but cannot guarantee continuous, uninterrupted or error‑free availability.

RevitalSource maintains the Platform and may release updates to implement changes, add functionalities or improve performance.

RevitalSource reserves the right to modify or remove information or functionalities from the Platform at any time.

Information Provided by the User

By providing information through the Platform, the User agrees that such information may be shared with other Users in accordance with the Privacy Policy.

The User must provide all information and documents that RevitalSource deems necessary for proper execution of the Service or legal obligations, in the required form and within the required timeframe.

The User guarantees the accuracy, completeness and reliability of all information provided to the Platform, including information originating from third parties.

The User indemnifies RevitalSource against any claims resulting from violations of the rights referred to in this article and shall compensate RevitalSource for any resulting damage or costs.

Privacy

RevitalSource complies with all applicable laws and regulations regarding the protection of personal data. For more information, RevitalSource refers the User to its Privacy Policy.

When a User’s access to the Platform ends, RevitalSource will delete all personal data and remove existing copies unless storage is legally required.

The User must inform RevitalSource immediately if, in the User’s opinion, any instruction constitutes a breach of the GDPR or other data protection laws.

Personal data relating to RevitalSource may not be processed by or on behalf of the User without prior written consent from RevitalSource.

Liability

Users use the Platform entirely at their own risk. RevitalSource accepts no responsibility for the behaviour of Users both within and outside the Platform.

RevitalSource is not liable for misuse of the Platform by Users, nor for discussions or information shared between Users.

RevitalSource has an obligation to make reasonable efforts to keep the Platform free from technical failures. Maintenance and development may limit or temporarily interrupt use, and may result in data loss. RevitalSource cannot guarantee uninterrupted availability or the absence of technical issues or data loss.

RevitalSource may temporarily or permanently disable or discontinue the Platform without Users being entitled to any rights or compensation.

The User is responsible for all actions carried out via their account. RevitalSource is not liable for information shared by Users on the Platform.

RevitalSource accepts no liability for the accuracy, completeness, quality or timeliness of the information presented on the Platform. Any liability for damage resulting from reliance on this information is excluded.

The User indemnifies RevitalSource against all claims from third parties relating to the User’s use of the Platform.

Complaints

Complaints from Users must be submitted to the relevant Third Party. Full responsibility for the Offer and the execution thereof lies with the Third Party.

If a User has a complaint about the Platform itself, it must be submitted to RevitalSource by email.

After receiving the complaint, RevitalSource will acknowledge receipt and aims to handle complaints as quickly as possible.

Complaints must be submitted in a timely manner after detection of the issue and must be clearly and fully described.

Confidentiality

The User must prevent confidential information related to the Platform and the Services/Products from being disclosed to third parties. Without written permission from RevitalSource, the User may not share such information, and may only disclose it to employees when strictly necessary.

The confidentiality obligation does not apply to information that:

  • was already publicly known;

  • is of general public knowledge;

  • must be disclosed due to legal obligations or court orders.

Users must also impose confidentiality obligations on any third parties they engage.

Intellectual Property Rights

All intellectual property rights relating to the Platform — including software, texts, graphics, logos, and images — belong to RevitalSource or its licensors.

Users may not copy, reproduce, distribute or publish any part of the Platform without written permission from RevitalSource, except for personal use.

RevitalSource provides no guarantees that the Services/Products provided to the User do not infringe any intellectual or industrial property rights of third parties.

Penalty Clause

If the User violates these Terms and Conditions, the User shall owe RevitalSource an immediately payable and non‑negotiable fine of €5,000 plus €500 for each day (or part thereof) that the violation continues.

This penalty does not affect RevitalSource’s right to claim full compensation for damages, costs and interest.

Amendments to the Terms and Conditions

RevitalSource may amend or supplement the Terms and Conditions at any time.

If the User does not accept a change, they may stop using the Platform before the new terms take effect. Continued use after the effective date constitutes acceptance.

Other Provisions

If any provision is found to be invalid or unenforceable, this does not affect the validity of the remaining provisions.

Dutch law applies to all legal relationships between RevitalSource and the User.

The competent court in the jurisdiction of RevitalSource shall have exclusive authority to resolve disputes.
